Lorain County adopted new conveyance standards this spring after holding public hearings to allow for participation by the public and private sectors. The revised standards can be obtained from the Lorain County Auditor's transfer office (226 Middle Ave., 2nd Floor, Elyria, Ohio; 440-329-5207) or viewed on its website at http://www.loraincounty.com/auditor/real-estate-taxes/land-conveyances/.
It's important to keep in mind that every county in Ohio has its own conveyance standards. These standards are established by the county's auditor and engineer as authorized by the Ohio Revised Code (see Section 315.251), and they have wide latitude under Ohio law to determine what the standards are. Ohio has 88 counties and it is possible for there to be 88 different conveyance standards.
As a result, real estate professionals, particularly any attorney that represents clients real estate, such as real estate developers, surveyors, title companies, mortgage lenders, etc. should become familiar with the conveyance standards of each county where a project is pending or risk having their filings rejected.
